Live Story Terms of Use for Visitors

Rules for using the service, guest accounts and access to routes.

Draft — effective date to be determined.

1. Who operates Live Story

  1. Live Story is operated by Marcin Czepiela, trading as Marcin Czepiela Software Development, at ul. Zofii Gumińskiej 16/1, 51-215 Wrocław, Poland, tax identification number (NIP): PL8952254462, REGON: 524700720, referred to as the “Operator”.
  2. Contact the Operator by email at contact@live-story.eu or by post at the address above.
  3. These terms govern use of the Live Story website by people visiting places and accessing visitor content.
  4. Managing venues, publishing materials in Studio and using organisation plans are subject to separate terms.
  5. These terms are available free of charge in a form that can be saved and reproduced.

2. Definitions

  • Service means the Live Story website and its visitor features.
  • User means a person using the Service.
  • Venue means an entity publishing information in Live Story about a place, exhibits, exhibitions, routes or events.
  • Materials include texts, photographs, audio recordings, videos, quizzes and route descriptions.
  • Guest account means a technical account that identifies a User without requiring an email address.
  • Sign-in account means an account secured with an email address and password or another available sign-in method.
  • Route access means permission to use specified materials under the conditions stated when access is provided.

3. Services we provide

  1. The Service allows Users to find and discover venues, browse visitor materials, open content using QR codes, receive route access, save available routes and visit progress, use recordings, videos and quizzes, and maintain an account and manage available settings.
  2. Available features depend on the materials published by the venue, permissions granted and the capabilities of the User’s device.
  3. Public materials can be viewed without registration. Features that save permissions or progress may require a guest account or a sign-in account.
  4. Creating a User account is free of charge.
  5. Internet connection charges may apply under the User’s agreement with their provider.

4. Starting use and technical requirements

  1. The material browsing service starts when the selected page is opened and lasts while that feature is used.
  2. The account service starts when an account is created and continues until terminated under these terms.
  3. A device with internet access and an up-to-date browser is required. Interactive features require JavaScript.
  4. Keeping a User signed in requires storage of essential website data. Blocking or deleting it may affect a guest account.
  5. Registration and recovery of a sign-in account require access to the email address provided.
  6. Scanning QR codes with a camera requires a device with a camera and the relevant permission. Opening a received link does not require camera access.
  7. Not all materials are available without the internet. Where offline use is available, it is indicated for the relevant feature.

5. Guest accounts and saved routes

  1. A guest account may be created when receiving access to a private route. It does not require an email address but has an identifier that may be linked to permissions, progress and quiz answers.
  2. “Guest account” does not mean all associated data is anonymous.
  3. Sign-in data is retained in the browser on the User’s device. Associated information may also be stored on servers.
  4. Signing out, deleting website data, using another browser or changing devices may result in losing the ability to use the account.
  5. To enable account recovery and use on another device, the User can secure the account with an available sign-in method.
  6. Without securing a guest account in advance, standard access recovery may not be possible. The Operator may be contacted. Assistance requires securely identifying the account or permission concerned.
  7. Deleting data from a device does not automatically delete data from servers.

6. Sign-in accounts

  1. Users should provide accurate information to the extent required by a feature and use an email address they can access.
  2. Users should protect their password and not share sign-in details with unauthorised people.
  3. Suspected account takeover or unauthorised use of sign-in details should be reported to the Operator. An immediate password change is also recommended where possible.
  4. The Operator does not ask Users to send passwords by email.
  5. Some features may require email verification or signing in again.

7. Route access and QR codes

  1. A QR code may lead to public material or be used to receive a specific permission.
  2. The scope, expiry and any usage restrictions should be presented to the User when access is provided.
  3. An individual access code may be assigned to an account on first use. It should not be published or shared unless the access conditions allow this.
  4. Access may expire at the stated time or be revoked under its conditions, applicable law or an established case of misuse.
  5. Having an account does not grant access to all materials and routes.
  6. Expiry of access does not delete an account or visit history.
  7. If access does not work or has been revoked contrary to its conditions, the User may report the issue to the Operator or the venue that provided it.

8. Tickets and venue services

  1. Information about tickets, prices, opening hours and visiting rules relates to the offer of the named venue.
  2. Creating an account or opening material does not constitute buying a ticket or obtaining admission to a place.
  3. When a ticket or access is purchased directly from a venue, the named seller is the contracting party. Purchase, payment, complaint and any withdrawal conditions are governed by that contract and applicable law.
  4. The Operator is responsible for its own services. This section does not exclude that responsibility or the User’s rights against the seller.

9. Materials and rights of use

  1. Materials may come from the Operator, venues or other entitled entities. Authorship and source information may accompany the material.
  2. Making material available does not transfer copyright to the User.
  3. Users may use materials for the Service’s intended purpose and within the law. Other uses may require the rights holder’s permission.
  4. Circumventing security, impersonating others or disrupting the Service is prohibited.
  5. Supplying unlawful content, including in reports or messages to the Operator, is prohibited.
  6. Educational materials and route guidance should be used with regard to local conditions, signs and instructions from people responsible for safety.

10. Use by children

  1. Children may use age-appropriate materials, subject to rules on entering contracts and the role of legal representatives.
  2. Where a feature requires parental or guardian consent, it should be obtained before use.
  3. Parents, guardians and visit organisers should take into account that receiving access to a private route may create a guest account and record activity.
  4. The Service does not currently apply general automated verification of age or guardian consent.
  5. A parent or guardian may contact the Operator about a child’s account or data.

11. Privacy and messages

  1. Data processing is described in the Live Story Privacy Policy.
  2. Accepting these terms is not consent to marketing or optional analytics.
  3. Email and push notification settings are separate. Users may change the available communication settings.
  4. Disabling optional communications does not exclude messages necessary for account administration, security or fulfilling a User’s request.

12. Technical issues and complaints

  1. Complaints concerning Live Story may be sent to contact@live-story.eu or by post to the Operator.
  2. It is helpful to include the issue, when it occurred, the page address or route name and contact details. Do not send passwords or full access claim codes.
  3. Missing information does not prevent a complaint. The Operator will request additional information if necessary.
  4. The Operator responds to consumer complaints within 14 days of receipt unless applicable law provides another deadline. The response is provided on paper or another durable medium, particularly email.
  5. These terms do not limit statutory rights arising from non-performance or improper performance, including conformity of a digital service with the contract where the relevant rules apply.

13. Reporting illegal materials and access restrictions

  1. Materials that may violate the law or others’ rights can be reported to contact@live-story.eu.
  2. A report should enable the material to be located and the allegation understood. Include its address or location, an explanation of the infringement and supporting information where possible.
  3. The Operator handles reports with due care. It may request more information and take appropriate action, including restricting access to material.
  4. Account use may be restricted for a breach of law, a material breach of these terms or a security threat. Action should be proportionate to the cause.
  5. Where circumstances allow, the Operator first notifies the User of the breach and allows it to be remedied. It may act immediately in an urgent threat.
  6. A person affected by a restriction may request an explanation and reconsideration. The Operator provides reasons to the extent required by law.

14. Ending use

  1. Users may stop browsing the Service at any time.
  2. The account service can be ended using an available deletion function or by contacting the Operator, which may verify the requester’s authority.
  3. Signing out does not delete the account.
  4. Account deletion may prevent use of associated routes and progress. It does not remove the right to complain or pursue claims.
  5. Data deletion, including records stored separately from the profile, is described in the privacy policy.
  6. Where a User has a statutory right to withdraw from a distance contract, it may be exercised under applicable law. Creating an account or starting use does not waive that right.

15. Changes to the service and terms

  1. The Operator may make changes necessary for security, error correction, legal compliance or adaptation to technical changes.
  2. Changes to these terms may result from changes in law, the scope of services or how they work. The Operator states the reason, scope and effective date.
  3. Changes affecting an ongoing account service are notified with appropriate advance notice, normally at least 14 days. A shorter period may follow from a legal duty or an urgent need to remove a threat.
  4. Where required by law, information is provided on a durable medium.
  5. Changes may not remove acquired or statutory rights. In particular, they do not provide an arbitrary basis for shortening paid access.
  6. Users may stop using the service and retain any additional statutory rights arising from a particular change.

16. Final provisions

  1. Polish law governs these terms, without prejudice to mandatory consumer protection rules applicable to the contract.
  2. These terms do not exclude or limit the Operator’s liability where this would be impermissible.
  3. Consumers may seek assistance from a municipal or district consumer ombudsman and available out-of-court dispute resolution procedures. Information is available from UOKiK.
  4. These terms do not impose exclusive jurisdiction on consumers based on the Operator’s registered office.
  5. The effective date remains to be determined.
